Basically, there are two types of non-Muslim marriages:
- Without Licence
Marriage without licence is the standard procedure for couples who meet all marriage requirements without requiring special approval.
- Age requirement: Both parties must be 21 years and above
- Marital status: Both parties must be single or widowed
- With Licence
Licensed marriage refers to situations where couples must obtain special approval (licence) before the marriage can be registered due to certain circumstances under the Law Reform (Marriage and Divorce) Act 1976 [Act 164].
Some of these circumstances include:
- Marriage without notice
If couples wish to marry without waiting for the 21-day notice period, they can apply for this licence.
- Marriage with a female partner aged 16–18 years
Application for this licence must be submitted and is subject to approval managed by JPN.
- Marriage at a place other than the registrar’s office
If couples wish to marry at a location other than the registrar’s office such as a hall or any house of worship, they must apply for this licence.
- Marriage between parties with prohibited family relations
If couples have certain family relations that are usually prohibited, they can apply for this licence for special approval.
Approval will be granted by the Chief Minister after considering the applicable law, religion, customs, or practices.
